The Southwest Florida 511 website (accessible through the Universal Service Locators (URLs): www.southwestflorida511.com, www.southwestfl511.com, and www.swfl511.com), provides travel information for specific roadways, areas and facilities within the three southwest Florida counties of Lee, Collier and Charlotte. Your access to the website or use of the Service constitutes your acceptance of, and compliance with, the following Terms of Service. If you have not already done so, please take some time to familiarize yourself with these terms. Note that these Terms of Service may change from time to time and it is your responsibility to periodically return to view updates. Reserved Rights and Grant of Limited License

Information provided through the 511 telephone service, and the Southwest Florida 511 website, is owned by the Florida Department of Transportation (FDOT). Content available through these Services is for individual use only and is not available for re-sale or re-use without the express written consent of the FDOT.

Users of these Services are granted non-exclusive, non-transferable limited license to access and use the Information for personal purposes only (and specifically excluding any commercial use).

Not an Endorsement

The mention of another agency or entity in relation to any information received by FDOT for use in the 511 telephone or website services does not constitute an endorsement, sponsorship or recommendation of that entity or its product or service. The accuracy of information provided by another agency or entity is the responsibility of that agency or entity, and the FDOT shall not be held liable for any inaccuracies based on such information.

Warranties

Information provided on the 511 telephone service, website and MyFlorida511 service is believed to be reliable when posted or made available. However, the Information and systems generating the Information are complex and may be subject to defects or errors, thus providing inaccurate information from time to time. Additionally, it is understood that traffic and travel information is dynamic in nature and subject to change from moment to moment. The FDOT does not guarantee the reliability, accuracy, quality, timeliness, usefulness, adequacy, completeness or suitability of the Information, or the results to be obtained beyond that which might be considered reasonable by a regular user of the services and systems.

You should not assume that your use of the Service will be error free or that the Service will operate without interruption.

Liability

You assume all risk arising from your use of the Service, and/or use of any information retrieved from or sent to you from the Service. To the maximum extent permitted by law, FDOT and its licensors shall not be responsible or otherwise liable for any claim, expense, damage, loss, liability, obligation, demand or action, regardless of the nature of the cause of the claim, demand or action, for any direct, indirect, special, incidental, consequential, exemplary, punitive or any other damages arising out of or in connection with the use of or inability to use the Service, or in reliance on the information, including any loss of use, lost data, lost business profits, business interruption, personal injury, or any other financial loss, even if FDOT, its contractors, licensors or agents have been informed of the possibility of such loss.

Choice of Law

These Terms of Service shall be governed by and construed in accordance with the laws of the state of Florida, excluding its conflicts of law rules. Through the use of the Service you expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these Terms of Service or your use of the Site or Services shall be filed only in the state or federal courts located in the state of Florida.
